February 25, 2009 Talks Update
The Lands Resolution Side Table met on Wednesday February 25, 2009 at the Oneida Business Park.

The Haudenosaunee Six Nations (HSN), Canada, and Ontario representatives were in attendance and Canada’s position paper on the Plank Road Bed and the Nathan Gage Patents were presented.

Canada’s position on the Hamilton Port Dover Plank Road Bed is that Canada believes that the Province of Canada acted in the best interests of Six Nations by dedicating and constructing the Plank Road as a public highway, although no direct compensation was paid for the road bed acreage (96 acres) itself. This was consistent with the practice of other land owners at the time and enhanced the value and marketability of the lots sold for the benefit of the Six Nations.

Canada’s position on the Nathan Gage Patents is that they concluded from historical records that Six Nations did not receive compensation for the approximately 20 acres of surrendered land that were ultimately patented to Nathan Gage. In Canada’s view, compensation should have been paid to Six Nations, but they have not tried to determine what that compensation might be and additional work would be required.

All parties agreed to have a Lands Resolution Side Table meeting every 2nd Wednesday to move the process along.

All parties agreed to have another Main Table to discuss the effectiveness of Side Tables, protocols, process and the possibility of having a mediator to attend the meetings.

HSN will respond to Canada’s position at the next Lands Resolution Side Table Meeting.

Next meeting dates:
Lands Resolution Side Table meeting will be held on Wednesday, March 11, 2009 from 10 a.m. to 12:00 and the Main Table will be the same day at 1 p.m.
